THIS IS A LEGALLY BINDING DOCUMENT. By signing, you acknowledge that you are voluntarily participating in a hazardous activity and giving up legal rights, including the right to sue Aqua 6ix Water Sports Inc., its owners, employees, and agents for ordinary negligence to the fullest extent permitted by law. Do not sign if you do not understand it.

Your Details

I acknowledge that operating/riding a Sea-Doo is inherently dangerous, involving known/unknown risks resulting in serious injury, disability, or death. Risks include: collisions (boats, docks, swimmers, debris, wildlife, hazards), high-speed impacts, capsizing, ejection, drowning (even with life jacket), rough water, currents, changing weather, mechanical/fuel failure, rescue failure/delays, operator error, third-party negligence, slips, and hypothermia. I assume ALL KNOWN AND UNKNOWN RISKS.

I certify that: I am 21+ years old with valid govt. photo ID; I am physically/mentally fit and not pregnant; I do not suffer from seizures, epilepsy, vertigo, heart disease, spinal/neck/shoulder injuries, recent surgery, uncontrolled diabetes, or conditions impairing safe operation.

I am not under the influence of alcohol, cannabis, illegal drugs, or impairing medication. Aqua 6ix reserves the absolute right to refuse service without refund if impairment is suspected.

I agree to: wear an approved life jacket at all times; attach the engine safety lanyard; follow all staff instructions; ride only in designated areas; never race/perform dangerous manoeuvres; maintain safe speeds; ensure passengers comply. Violations result in immediate termination without refund.

I accept equipment in satisfactory condition unless reported before launch. I accept full financial responsibility for damage due to negligence, reckless operation, missing/lost equipment, towing/recovery, cleaning, administrative costs, loss of business revenue, and costs exceeding the mandatory $500 authorization hold.

As primary renter, I accept full responsibility for the conduct, safety, and actions of all passengers accompanying me.

Rentals may be delayed, shortened, or cancelled due to weather, high winds, lightning, mechanical issues, water conditions, government/police actions, or safety concerns. Refunds/rescheduling follow published policies.

I acknowledge that Aqua 6ix utilizes GPS technology for safety monitoring, theft prevention, equipment recovery, and operational management.

Aqua 6ix is not responsible for loss/damage to personal property including phones, wallets, cameras, GoPros, keys, glasses, or jewelry.

If injured/incapacitated, I authorize Aqua 6ix to contact emergency medical services and obtain treatment on my behalf.

To the fullest extent permitted by the laws of Ontario and Canada, I release, waive, and forever discharge Aqua 6ix Water Sports Inc., its owners, officers, employees, and agents from all claims, damages, losses, or liabilities arising from my participation, including claims based on ordinary negligence, except where liability cannot legally be excluded.

I agree to defend, indemnify, and hold harmless Aqua 6ix Water Sports Inc. from all claims, lawsuits, legal fees, or liabilities arising directly or indirectly from my participation, negligence, passengers, or damage caused by my actions.

Aqua 6ix may retain electronic signatures, initials, IP addresses, browser/device info, and timestamps as binding evidence of this agreement.

If any provision is found unenforceable, the rest remain fully valid. This is the entire agreement and supersedes all prior representations.

Governed exclusively by the laws of Ontario and Canada. Legal proceedings must be brought exclusively before the courts of Ontario.
